It is important to note that inerts and raw materials are not considered pesticides until they become part of a pesticide product. Intermediates used in the manufacture of a pesticide are not excluded from regulation under TSCA, unless they are pesticides themselves and are being used in a mixture for their pesticidal properties, or are not isolated during the manufacturing process. While pesticides are exempted from TSCA, fertilizers and other substances used in the growing of crops are not exempt.

The signal word DANGER must appear on labels of all highly toxic products; this word alone is sufficient for products for which the principal concerns are eye and/or skin hazards. If a product is highly toxic due to oral, dermal, or inhalation exposure, the label must also bear the word POISON and the skull-and-crossbones symbol. A taste to a teaspoonful taken by mouth could kill an average-sized adult. Any product that is highly toxic orally, dermally, or through inhalation will be labeled DANGER-POISON.

The protection afforded under this act is based on a system of drinking water standards set by the EPA.
